GOLDEN, Colo. -- A couple from Evergreen accused of nearly starving their 6-year-old daughter to death are expecting another baby.

Kathleen Barton, 36, was visibly pregnant when she appeared in court Tuesday. She is seven months pregnant with the couple's fourth child.

She and her husband, 40-year-old Jason Barton, are charged with child abuse resulting in bodily harm in the case of their oldest child.

Prosecutors said the couple placed locks on their refrigerator and pantry to keep their 6-year-old girl from eating. She weighed what a 2-year-old should weigh, just 25 pounds, when doctors at Children's Hospital examined her in June.

The Bartons asked for a gag order in court Tuesday based on what the district attorney told FOX31 Denver last month. That's when we learned threats had been made against the couple.

"It's not unusual in a case that has facts that really grab the public's attention for my office to receive communication from the public expressing their opinions as to what should happen and that has happened in this case," Jefferson County District Attorney Peter Weir said.

The judge said she will decide in August whether to grant a gag order.

The Bartons' three children are in protective custody. Officials said the 6-year-old was the only one who was mistreated.

Prosecutors said it will be up to Jefferson County Human Services to file a motion if it believes the Bartons' newborn should be taken away when the baby is born in mid-September.
