PADUA, Italy — A disgruntled flyer is suing Emirates Airlines claiming his nine-hour flight was “ruined” because he had to sit next to an obese passenger during a nine-hour flight from Cape Town, South Africa, to Dubai, United Arab Emirates.

And the man took a selfie to prove it.

Giorgio Destro, a lawyer from Padua, Italy, said he is a “gold member” flyer, but said the airline wouldn’t let him change seats because of the full flight, according to Italian newspaper Mattino Padova.

He said he never even received an apology or any form of compensation following the flight.

Destro is reportedly seeking about $3,079 in damages from the airline because of “spillover” from the man sitting next to him.

“For nine hours, I had to stand in the aisle, sit on seats reserved for the cabin crew when they were free, and in the final phase of flight resign myself to suffer the ‘spillover’ of the passenger at my side,” Destro told the Italian paper.

Emirates Airlines has not commented on the matter. A court hearing is expected to take place Oct. 20.
