Guilty times 165: Jury convicts Aurora theater shooter on all counts

CENTENNIAL, Colo. -- Nearly three years after slipping into a packed movie theater and opening fire in which he killed 12 people and injured 70 others, an Arapahoe County jury on Thursday convicted the Aurora theater shooter on 165 counts -- including 24 counts of first-degree murder -- in a verdict that could lead to the death penalty.

The nine-woman, three-man jury returned the verdict after nearly 13 hours of deliberations, which began Wednesday at the Arapahoe County Justice Center. The verdicts came 1,091 days after the massacre took place on July 20, 2012.

Admitted gunman James Holmes stood in Courtroom 201 with his hands in his pockets as Judge Carlos A. Samour Jr. read the verdicts beginning at 4:15 p.m. It took 61 minutes to read the verdicts.

The shooter expressed no emotion as the verdicts were handed down and neither did his parents, who were seated in the courtroom. Jurors were seen passing a box of tissues around as the verdicts were read.

Moments after the verdicts were read, it began raining outside the courthouse.

Holmes had pleaded not guilty by reason of insanity to the 165 charges for opening fire in Theater 9 of the Century Aurora 16 movie theater during a midnight showing of the Batman film “The Dark Knight Rises.”

The trial next will go to the penalty phase in which the same jury will decide if the shooter will receive the death penalty or be sentenced to life in prison without the possibility of parole.

The trial for the 27-year-old shooter began with jury selection on Jan. 20 and opening statements on April 27. There were 256 witnesses called to testify, including dozens of victims of the shooting. The prosecution rested on June 19 after 34 days of testimony and the defense rested its case on July 10 after 12 court days.

Closing arguments were held Tuesday and the jury began deliberations Wednesday morning. The jury reached its verdict around 1 p.m. Thursday.

Juror 737, a survivor of the Columbine High School massacre, was chosen as the foreman who signed off on the verdict forms tendered to the court.

Arapahoe County District Attorney George Brauchler focused his closing argument on the massive toll on the victims, recalling their stories and attempting to show the shooter was legally sane at the time of the attack.

"That guy was sane beyond a reasonable doubt and he needs to be held accountable for what he did," Brauchler said during his closing argument.

Defense attorney Daniel King used his closing to say the shooter was a victim of schizophrenia and that he was unable to tell right from wrong when he went into the theater and opened fire. King showed jurors images of the shooter looking dazed with bright orange hair after the attack.

"When he stepped into that theater, the evidence is clear that he could not control his thoughts, that he could not control his actions, and that he could not control his perceptions," King said.

Despite 49 days of highly emotional and complicated courtroom testimony and arguments, the jury did not buy the defense's argument and returned the guilty verdicts swiftly.
