Convicted rapist doesn’t show up for sentencing after judge granted bail

BOULDER, Colo. -- A convicted rapist who was let out of custody after a jury convicted him of sexual assault did not show up to his sentencing hearing last week.

Calvin Nagy, 37, was convicted of sexual assault -- a Class 4 felony -- along with other charges in November.

Prosecutors asked Boulder District Judge Andrew MacDonald to rescind Nagy's bond of $7,500.  He had been free on the bond during his trial. The judge denied the request.

Nagy lives in Vail and was required to check-in daily with community justice services. Officials said he stopped doing so the week before his sentencing.

He did not show up to his sentencing hearing. His bond has been revoked and an arrest warrant has been issued.

Nagy was previously convicted of sexual assault in Boulder in 1996 and was sentenced to probation in that case.

In addition to the sexual assault conviction, a jury found Nagy guilty of misdemeanor charges including third-degree assault, attempted third-degree assault, criminal mischief and menacing.

Nagy faces up to life in prison.  Prosecutors said they wanted to have Nagy sentenced last week since it is not necessary for a defendant to be present at a sentencing hearing. However, the judge postponed the sentencing hearing indefinitely.

"The judge may have well found that even though this is a sex assault conviction, and terrible, that the community would not be in jeopardy if he let the defendant stay out until the sentencing," attorney Dan Recht told FOX31 Denver.

MacDonald was also the judge in a case of George Tiba who failed to appear on the final day of his trial in December. Tiba was arrested in California several days later.
