INDIANAPOLIS — The ex-wife of former Subway spokesman Jared Fogle is suing the sandwich chain, saying it knew about his sexual interest in children for more than a decade but did nothing about it.
Fogle was sentenced to nearly 16 years in prison last year after pleading guilty in a plea deal to having sex with minors, and receiving and distributing child pornography.
Fogle is serving his sentence at the Federal Correctional Institution Englewood in Littleton.
The lawsuit by his former wife, Katie McLaughlin, claims Subway received its first complaint about Fogle in 2004.
It says Subway received at least two other complaints that were ignored.
The lawsuit accuses the company of negligence and intentional infliction of emotional distress.
It also accuses it of misappropriation of likeness, saying it depicted her in an animated ad campaign without her consent.
The lawsuit asks for unspecific damages.
There has been no public response from Subway.
