GATES, N.Y. — A woman who was dressed as a zombie for a Halloween party was arrested twice for driving while intoxicated within a three-hour span, WHAM reported.

Police in Gates, N.Y., say Catherine Butler, 26, was driving without her headlights on after leaving a Halloween party early Saturday when she was pulled over. She was picked up by a friend after being charged with DWI.

Butler was pulled over again less than three hours later for driving drunk. Police say her blood alcohol level was 0.11 percent the first time and 0.09 percent the second time. The legal limit is 0.08 percent.

WHAM reported it was the fourth time Butler has been arrested for driving drunk. The previous charges were reduced to impaired driving and she was allowed to keep her license.

“…fourth time Butler has been arrested for driving drunk. The previous charges were reduced to impaired driving and she was allowed to keep her license.” I am going to guess she will not be keeping her license this time?

Sadly, the DA has his/her hands tied. A bill was up to make repeat DUI offenses over a period of time a felony (it was for a third DUI within a seven-year time period or a fourth DUI in a driver’s entire lifetime), but was voted down. Colorado is one of only 5 states without such a provision – so until there is major property damage, or somebody gets killed, it’s only a misdemeanor here.
