DA to decide whether to charge 80-year-old killer of intruder who yelled ‘I’m pregnant’

LONG BEACH, Calif. — When 80-year-old Tom Greer was attacked by intruders at his home, he fought back. When he got his gun and fired at them, they ran.

One of his attackers, a woman, shouted, “I’m pregnant!” He shot her twice, killing her.

The district attorney will decide Friday whether Greer will face criminal charges for his actions.

Long Beach Police Chief Jim McDonnell said Greer walked into his house Tuesday to find suspects Andrea Miller, 26, and Gus Adams, 28, ransacking it. According to McDonnell, Greer said this was the fourth time his house has been burglarized.

Police say the couple beat and threw the elderly man to the ground, causing him to suffer a broken collarbone, cuts and bruises.

Although injured, Greer managed to grab his gun and fire at the suspects, causing them to flee through the garage and into the alley, police said.

In an interview with KNBC, Greer said that as the suspects ran into the alley, Miller yelled, “‘Don’t shoot me, I’m pregnant! I’m going to have a baby!’ and I shot her anyway.”

According to McDonnell, Miller died in the alley.

In a news conference, McDonnell said the coroner will make the final determination of whether Miller was pregnant, but said it “wasn’t obvious” if she was.

When asked by KNBC how he felt about the incident, Greer responded that he had no regrets.

“I had to do what I had to do.”

The male suspect fled the scene, according to Greer. Adams was later arrested and charged with residential robbery and felony murder in Miller’s death. He is currently being held on $1.25 million bond.

    Seriously, charging an old man for protecting himself? Too bad he didn’t put a cap in the @$$ of the other thug, that is who should be charged for murder.

      Once the elderly man chased the suspects, he became the aggressor and it was no longer self defense. If he had of shot them while being attacked then that can be justified, but you have an obligation to retreat from the threat if possible not gun down a fleeing person who is no longer on your property (going based on the story saying she was in the alley). Its the same for police, they cannot shoot a fleeing suspect who is no longer a threat. For example the famous “stop or I’ll shoot” line from many movies is non sense. Deadly force is only justified as a LAST RESORT.

        During the pursuit if the person turns in an aggressive manor then yeah blast away, that’s what the police do. Show me a law that says I have to run away

        Cheri, you’re assuming that when she yelled “I’m pregnant,” she was telling the truth, and that just because she left his home he no longer posed a threat. If you watched any of the video of the recent car-jacking pursuit that ended with the capture of a criminal on I-70, you’ll notice his hands were up and he was saying “Don’t shoot me!” but he wasn’t actually giving up. He was still trying to hijack another vehicle and he was still defying police authority. These two had broken into this man’s home, and had beaten him severely. There was no guarantee, based on her previous behavior, that she was no longer a threat. Maybe she was in an alley, but that doesn’t mean she wasn’t still a threat. According to the police report this was the THIRD time the homeowner was robbed, and there’s every reason to believe these two had broken in before. In the homeowner’s mind they posed a continued threat.

        There is no duty to retreat in Colorado and many other states, in order to claim self-defense. I am not sure about California.

        You say that because you have a calm clear mind but I’m sure once you walk into some one ransacking your house for the third time an they beat you an leave you for dead I’m pretty sure you’ll try to chase them an shoot them if you get the chance .

        @Anonymous; believe it or not, Kalifornia is a “Stand your ground” state.

        @Cheri: in Colorado, C.R.S. 18-1-702 and 18-2-704.5 state deadly force can be my first, last and only option if I deem necessary. In Kalifornia, CALCRIM 506 says that he was still justified in using deadly force RUNNING AFTER the perps.

        And for the record, the coroner determined that she wasn’t pregnant. She was trying to save her skin after beating up an 80 year old man.

      And he was–it’s called felony murder, where if you are committing a felony and someone gets killed in the process, you are held responsible, even if you didn’t pull the trigger.

    So – she chooses to break into an 80 year old’s house beat and rob him then wants to yell “I’m pregnant” and call it good? She made that choice pregnant or not, she was accountable for what she did. Now he may actually get in trouble for defending his life? Crazy.

      So “Ian JOuett” your saying that the death penalty is proper punishment for burglary and assault/battery? Yes she should have been punished by the justice system, but not killed while fleeing and unarmed. If this elderly man actually believes he made the right call then he should not own weapons. Secondly it is people with your types of views that are helping the left wingers get more gun control laws put into place.

      You can only take a life to save a life, not because you just want to do it.

      This sounds unbelievable, when you talk about law in Kalifornia, but according to CALCRIM 506 he was justified in using deadly force and REMAINED justified even when the perps ran. Apparently, shooting someone in the back is still considered self-defense. In Kalifornia.

    I can’t help but see a correlation between this story, and what’s happening in the mid-east with Hamas and Israel. Hamas started the war, Hamas bombed Israel, and killed innocent Israelis, and then when Israel retaliates strongly, Hamas complains. This couple breaks into a man’s home and beats him to the point where bones are broken and cuts and bruises are present, but when the man defends himself, the criminals want there to be “rules” to protect them. This pair have a history of criminal activity and show no signs of stopping. They posed a continued threat to the community.

    If you read th estory correctly. He still managed to get his gun and fire at them, causing them to flee through the garage. He didn’t shoot her in the alley, she died in the alley. He shouldn’t be charged.

      That’s not how the story is worded though. Maybe another article is more accurate? This one says:

      AS they ran into the alley he shot her.
