Oklahoma father dies in police encounter after mother slaps daughter

MOORE, Oka. — It was supposed to be a fun family outing to the movies, but then Nair Rodriguez’ 19-year-old daughter got under her skin. They fought, she said, and she slapped her daughter.

Moments later, police arrived on a domestic dispute call at the Moore, Oklahoma, theater and confronted — not Nair Rodriguez — but her husband Luis. They took him down, and after the encounter on February 15, he was dead.

Cell phone video taken by his wife and released this week shows the final minutes of the takedown.

Nair Rodriguez accuses officers of brutality. Police say they were following protocol and used no undue force.

Argument, upset

The mother-daughter spat upset the mother so badly that she bolted for the family car. Her husband Luis followed her to calm her down, family attorney Michael Brooks-Jimenez told reporters.

That’s when a group of police and theater security officers turned up, he said.

What happened next is disputed.

His wife has said officers beat Luis Rodriguez, KFOR-TV reported. But Moore Police Chief Jerry Stillings calls the actions of his officers “reasonable.”

He would not go in to much detail and said an investigation is underway. But he mentioned that police used pepper spray, KOCO reported.

Luis Rodriguez ended up on the ground with five men pinning him down, and wife Nair pulled out a cell phone.

Her fearful cries fill the recording.

“Luis! Luis!” she calls out frantically. Her husband does not respond, does not appear to move.

She calls to the officers to assure her that he is alright.

“Please somebody tell me that he is alive,” she implores. “He is not moving.”

The officers appear calm. One tells her that he will talk to her, once they are finished securing her husband.

Then one walks over to the camera. He tells her that police have called in a medical unit to check on her husband.

It wasn’t him

The officer says police received a call about domestic violence before confronting her husband.

It wasn’t him, Nair Rodriguez tells him. “I hit my daughter,” she says. She wants to know why they have pinned down her husband.

“He refused to give his ID,” the officer said. “He got combative.”

She notices blood on the officer. “Is he bleeding?” She demands to know.

“I’m bleeding; that’s me,” the officer says.

An ambulance can be seen in the background, and Luis Rodriguez is lifted onto a stretcher.

The video ends shortly afterward.

Cause of death

An autopsy may reveal more about why Luis Rodriguez died, and surveillance camera footage of the encounter in the movie theater parking lot may reveal what happened before his wife pulled out her cell phone camera.

What police describe as normal procedure, lawyer Brooks-Jimenez describes it as something brutal and possibly deadly.

Pepper spray to the face and the weight of five men on top of him.

    It is a shame…. but this is a tough one. Police, while often corrupt, many are not, and are faced with so many dangerous and violent situations. It wasn’t looking good when they arrived. I am truly sorry to hear of this death, but I want to take this opportunity to say to every parent: don’t reduce yourself to hitting and slapping children/teens. This obviously wasn’t a first occurrence of violence. Please realize that without violence, this likely would not have occurred. Learn to be a true adult before parenting any child or teen. Learn to handle every situation possible with dignity, respect, and composure before resulting to anything physical other than hugs.

      I’m sorry but it sounds like the daughter deserved a good smack from her mother. I would never spank my daughter but I expect her to know if she acts inappropriate and is way out of line, she will get punished by her mom. If i had a boy yelling and cussing at me, he will get smacked right in the mouth by me. It’s people like you that raise kids that don’t listen to you, yell at you, throw things at you, and ultimately do horrible things. I grew up knowing if I acted up I got a spanking, and I’m perfectly normal.The cops were completely out of line and their “protocol” excuse is unacceptable.

      ARE U SERIOUS WITH WHAT U WROTE CLAIRE … U BLAME IT ON THE FAMILY , GET REAL !! DEATH SHOULD NOT OF HAPPENED TO THAT MAN IN THE HANDS OF POLICE . tHEY KILLED HIM AND SHOULD ALL BE PUT IN JAIL FOR LIFE !!!

    Good work POLICE OFFICERS! And you wonder why the people don’t TRUST you anymore. Because it takes 5 police officers to subdue a defenseless man and crush him to death.

      I wouldn’t be so quick to assume the cops were at fault. Sounds like a dysfunctional family airing their dirty laundry in public, a 19yr old acting out, not a child but an adult, and the mother disgracefully acting inappropriately. To give some benefit of the doubt, law enforcement does not usually wrestle you to the ground if you comply with their requests. However, someone should not die while being held in police hands. Sounds like an f’d up situation all around, and wonder how the 19 yr old is gonna live with acting like a brat and possibly causing the event that her dad died in. That’s a hell I would not want on my shoulders. The poor man paid the price for the women acting like idiots.

      FIRST of all many know that you cant’ breath with pepper spray, they also know you can’t breath while they are pushing on your back now are they waiting for him to pass out meanwhile he is getting no air? This has happened in a LOT of places this is NOT the first case of people dying with pepper spray and being held down why isn’t he hand cuffed or turned over why is he continually being pushed down granted he is a big guy but judging from the video he not moving or talking and he continues to have 1000lbs on him if each guy is 200 lbs that is a lot of weight…sad…..

    It takes 5 officers because of all the law suit happy excessive force lawsuits and officers not being able to do what it takes to control a situation. The husband wouldn’t give his ID. Probably had a warrant and why is a mother slapping her 19 year old daughter? Sounds like a winner of a family to me…

    I saw nothing wrong in the way they handled the situation from a BIG guy giving a hard time. If he obeyed the law it would have not gotten to that point. I rather see a Trouble maker die than some one who actually protects and serves. if it was one officer trying to calm him down how would know if the old man would punch or tried grabbing his gun. Its Dangerous to be a cop out now a days with so many crazy people especial if there on drugs. So I saw nothing wrong and I have seen some wrong doing

      It’s pure bull that any one would try and justify the actions of those police. It’s clear from the video that they were all on top of him when he wasn’t moving at all. Then you see the fear in the faces of the police as they try and cover up that the man is obviously life less, and instead of trying to revive him, they try and hold him up leaning him up against their legs. It even shows an officer trying to find a pulse…. It’s quite clear these police officers knew they killed this man and were so guilty and unskilled, that they were only interested in trying to convince his wife he was alive that they neglected to do what any trained police officer or any humane person would do immediately which is try and revive the man, and perform CPR that was so obviously needed.
      And so cowardly and inhumane all who work for the department, will try and cover up and justify, instead of take accountability and admit these officers were wrong and give them the punishment the deserve and need.
      There is too much police brutality going on, and it will continue, and get worse because of the way these cases are cover up, and justified.
      Sadly this will cause many to hesitate to call for help when it’s needed in fear of something like this happening.
      No matter how any one tries to justify this type of behavior from our police, it’s clearly WRONG, and UNJUST!!!

      Obey the law? What was his crime, innocent by stander? If you have not broken any laws or are not being detained you are under no obligation to do what the police tell you like giving your name or presenting idenification its in the constitution read it, especially when you have someone addmiting they are the one that commited the crime and he had nothing to do with it. Give me a break Five cops to subdue one man after he was pepper sprayed! Who was this guy Bruce Banner?

    WHY WERE 5 OF THEM HOLDING HIM DOWN, AFTER USING PEPPER SPRAY AND WHY DID IT TAKE THEM SO LONG TO CUFF HIM? …AT THE VERY BEGINNING, YOU CAN HEAR HIM TRY TO SAY “I CAN’T BREATHE” AS THE ONE OFFICER PUSHES HIS FACE BACK DOWN. JUST SAYING, I HAVE ASTHMA, AND WHEN I CAN’T GET MY BREATH, I GET COMBATIVE AND COME UP SWINGING FOR AIR… IT’S SCARY!!! MAYBE THAT IS WHY THIS MAN WAS RESISTING/FIGHTING FOR AIR??

    It is clear in the footage that the officer that held his head down was squeezing his main artery to kill him. It only takes a few seconds to do . The other cops were doing things to him as well .this would intell by holding him down you would not of seen his body jump as it would when you are gasping for air!! This is why people shoot at police first because they know they will kill first…… They are all responcable for that mans death!

    The reason why the justice system and law enforcement in the US is going backwards instead of being progressive, is that justice in the US increasingly acts according to stereotype. Who instructs the police automatically to assume the male to be guilty in a domestic dispute and then to treat the male like an animal ? Every bit of reputable research coming out now shows that women are as much perpetrators of serious domestic violence as men are and yet the police approaching an alleged DV situation and immediately use this as an excuse to beat up the man. Research also shows that the police have a disproportionate number of violent officers who need to beat up somebody to satisfy their drives. The police cannot operate off a stereotype. It is unconstitutional and inhumane. previously, the police steeotyped blacks. Today, it is male human beings who are stereotypes as monsters. Not appropriate to a country that trumpets itself as a fair democracy where all its citizens are treated equally and justly.

    I”m sooooo disgusted with this…first of all no one said a man was hitting anyone THEY ASSUMED without even asking…this is soo soo sad and the cop kept blocking her view so she couldn’t film or be with him in his last minutes….5 people were acting like they were doing something hard pushing on his body for no reason he wasn’t even moving.
