WESTMINSTER, Colo. — A man apparently killed his 1-year-old daughter before shooting himself Monday morning in a domestic incident in Westminster.

The shooting near 72nd Avenue and Stuart Street was reported about 9:35 a.m., the Westminster Police Department said. Dispatchers received a 911 call from a woman saying her ex-boyfriend, 22-year-old Merrick McKoy, was in her apartment and that he had a gun.

McKoy, who was the father of the woman’s young daughter, is the subject of a restraining order forbidding him from being at the address, police said.

After a scuffle, the woman fled the apartment and called police again from a neighbor’s home. The child was left behind.

Police arriving on the scene a short time later heard gunshots. Upon entering the apartment, they found that both the man and the child had been shot.

The child, identified as Mia McKoy-Phanthavongsa, died of her injuries, police said. McKoy’s condition was not released.

A family member said McKoy had taken a photo of himself with his daughter and posted it to Facebook shortly before the shooting.

On Monday morning, a Facebook page allegedly belonging to McKoy featured the status update “Don’t judge me had no choice.”

Police were still investigating exactly what happened in the apartment.

“McKoy, who was the father of the woman’s young daughter, is the subject of a restraining order forbidding him from being at the address, police said.”

They should refund this lady her court costs, the restraining order did not help. Talk about selling a false sense of security.

They say restraining orders are just a piece of paper. This proves it once again. I agree 100% Test.

It is really too bad their are people out there that hurt kids like this. It’s a shame that the innocent are victim’s. God rest this little ones soul.

  • Brice Trumey says:

@ Amber: The little one’s soul wasn’t at peace until you commanded god to rest it? God created the little girl and god knew what her fate was. God ignored her cries. Pathetic.

@ Test and April: Restraining orders actually do work in most cases. Not even 24 hour police protection could have stopped this crazy person.

A restraining order won’t stop anyone. If she had a gun of her own and the training to use it at least then the child may still be alive.

  • Anne says:

Agree with Sarah. If mom had a gun and knew how to use it, this waste of oxygen would’ve been taken out and her baby girl still alive. The system is a joke.

Why didn’t she take her daughter with her when she fled from her apartment? This is really sad, the little girl didn’t deserve to die.
