Judge: Preschool teacher facing child porn charges can be released on bond

DENVER — A judge ruled late Wednesday that former preschool teacher David Moe can post bond to get out of jail with some conditions.
Federal prosecutors and parents of children at the school where he taught wanted him held without bond.
Moe, 45, faces federal charges related to the possession and distribution of child pornography. He has been in jail since his arrest July 24.
He taught for 18 years at the Paddington Station preschool in Denver.

Investigators said he kept detailed notes about his physical interactions with dozens of toddlers while he worked at the preschool. The notes are from an 800-page journal they found while searching Moe’s home in Denver.
Investigators say there is nothing overtly sexual in the journal, but there are details about Moe hugging, tickling and kissing toddler girls.
Court documents say Moe told investigators he collects and trades child pornography.
Federal Magistrate Judge Michael Hegarty says prosecutors failed to prove Moe is a danger to society if he is allowed out of jail on bond. The ruling came after a three-hour long hearing Tuesday.
The list of restrictions is long. Moe must adhere to home incarceration, with no permission to leave the house other than for court appearances. He must live at his parents’ house and he must wear an electronic tracking device.
In addition, he cannot have any contact with any children. He is prohibited from accessing the Internet and Internet service at his parents’ house must be shut off.
Bond has not been set for Moe.
